Terms of Service.

• It is understood Justin Dadswell is the exclusive official photographer retained to perform the photographic services requested by the client.

• *** Price restrictions apply depending on quantity, complexity and size

• All images taken by the photographer are sole property of Justin Dadswell

• Upon agreeing to these terms, Justin Dadswell shall reserve the time and date agreed upon. Unless the photographer is able to fully replace the canceled reservation, all sitting fees and retainers are non-refundable, even if the portrait is rescheduled or canceled for any reason other than inclement weather.

• If, in the opinion of the photographer, inclement weather or other adverse conditions prevent the creation of a portrait meeting the artistic standards of the studio/photographer, photographer may elect to use an alternate location or to reschedule the portrait.

• No part of any order, including previews, will be delivered or shown until the balance is paid in full.

• It is understood that client does not receive, or is entitled RAW image files.

• Image galleries will be available for download for 7 days from the time of delivery. If edits are required client understands that they must notify the photographer of their choices within these 7 days.

• Clients understand that deposits are 50% depending on the total cost which is applied to the session fee and is non-refundable. Deposits can only be moved with a 48 hour notice from the scheduled appointment with proper notice via telephone by calling 647-218-5878 during normal business hours. Failure to notify the Photographer will result in a loss of the deposit. No exceptions.

• Clients understand that the full replacement cost of any damaged lights, modifiers, backgrounds or other equipment in the studio that have been damaged by the client will be charged in addition to any studio fees, taxes or other charges

• Headshots are defined as images primarily of the clients head cropped from above the head to the chest area and includes shoulders. Headshots are not 3/4 or full length photographs.

• Client understands and agrees that Client is hiring Photographer to perform Photographer's services in Photographer's own discretion and style. Client has no authority to control the manner in which Photographer takes photos. Client has no right to rescind this Agreement in any way if Client is not satisfied with Photographer's photography. Photographer reserves all creative rights for choosing which images will be presented to the client and removing any undesirable images from the collection. Photographer will make a good faith effort to achieve Client's desired results. However photography is a subjective art form, and Client acknowledges that Photographer cannot and will not guarantee any particular results, including Client's desired results.

• Justin Dadswell may substitute another photographer to take the photographs in the event of Studio/Photographer’s illness or of scheduling conflicts. In the event of such substitution, Studio/Photographer warrants that the photographer taking the photographs shall be a competent professional.

• If Justin Dadswell cannot perform this Contract due to fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to Photographer’s illness or emergency, then the Photographer shall return any deposit or sitting fee to the Client but shall have no further liability with respect to the Contract. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or media malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event the Studio/Photographer fails to perform for any other reason, Justin Dadswell shall not be liable for any amount in excess of all monies paid.

• The charges in this Contract are based on Justin Dadswell’s Standard Price List. This price list is adjusted periodically and future orders shall be charged at the prices in effect at the time when the order is placed.

• This Contract incorporates the entire understanding of the parties and is governed by the laws of Barrie, Ontario & Canada. Any modifications of this Contract must be in writing and signed by both parties.

• Any client that is a no show, or is more than 30 minutes late to their appointment may be subject to rescheduling/cancelation and a forfeiture of their deposit.

• All images taken for client may be used in website, portfolio, social media or other areas where Justin Dadswell may want to display work for personal or professional use. All clients grant consent for these standard usage terms. Should a dispute arise, all rights and usage remain at the discretion of the photographer.

• Image delivery of 48 hour turnaround is available for up to 3 images, which is not guaranteed in the event of unforeseen circumstances. Anything over and above 3 images will be done within a reasonable timeframe depending on the photographers schedule and delivered as soon as possible.

• A location fee, production fee, or any other additional costs incurred by the photographer may be charged to the client at the photographers discretion
